REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE

CONCERNING
PROCEDURE TO NOTIFY INWARD MANIFEST OF CARRIER AND OUTWARD MANIFEST OF CARRIER IN THE FRAMEWORK OF CARRYING IMPORTED GOODS AND EXPORTED GOODS TO AND FROM CUSTOMS ZONE IN INTEGRATED CUSTOMS SERVICE ZONE

Attachment

Considering:

a. that in the framework to increase service and control over transportation of imported and exported goods to and from Customs Zone in Integrated Customs Service Zone;

b. that in the framework to implement provision of Article 6 of Regulation of the Minister of Finance No. 90/PMK.04/2007 concerning Releasing Imported Goods or Exported Goods from Customs Zone to be transited or transshipped and Releasing of Imported Goods from Customs Zone to be transported to Temporary Hoarding Place in other Customs Zone as amended by Regulation of the Minister of Finance No. 102/PMK.04/2010, and in the framework to implement Article 16 of Regulation of the Minister of Finance No. 232/PMK.04/2009 concerning Integrated Customs Service Zone, it is necessary to arrange implementation direction of moving and transportation of imported goods and exported goods to and from Temporary Hoarding Place in Integrated Customs Service Zone;

c. that based on consideration as intended in paragraph a and paragraph b, it is necessary to stipulate a Regulation of the Director General of Customs and Excise concerning Procedure to Notify Inward Manifest of Carrier and Outward Manifest of Carrier in the Framework of Carrying Imported Goods and Exported Goods to and from Customs Zone in Integrated Customs Service Zone;

In view of:

1. Law No. 10/1995 concerning Customs (Statute Book No. 75/1995, Supplement to Statute Book No. 3612) as amended by Law No. 17/2006 (Statute Book No. 93/2006, Supplement to Statute Book No. 4661);

2. Law No. 11/1995 concerning Excise (Statute Book No. 76/1995, Supplement to Statute Book No. 3613) as amended by Law No. 39/2007 (Statute Book No. 105/2007, Supplement to Statute Book No. 4755);

3. Government Regulation No. 61/2009 concerning Port (Statute Book No. 151/2009, Supplement to Statute Book No. 5070);

4. Regulation of the Minister of Finance No. 39/PMK.04/2006 concerning Procedures for Submitting Notification about the Arrival Plan of Carrier, Arrival Manifest of Carrier and Outward Manifest of Carrier as amended by Regulation of the Minister of Finance No. 108/PMK.04/2006;

Regulation of the Minister of Finance No. 90/PMK.04/2007 concerning the Release of Imported and Exported Goods from Customs Zone for the Advanced and Next Transport and the Release of Imported Goods from Customs Zone for the Transport to Temporary Hoarding Place in Other Customs Zone as already amended by Regulation of the Minister of Finance No. 102/PMK.04/2010;

8. Regulation of the Director General of Customs and Excise No. P-10/BC/2006 concerning Procedures for Submitting and Administering Notification about the Arrival Plan, Inward and Outward of Manifest of Carrier as already amended the latest by Regulation of the Director General of Customs and Excise No. P-19/BC/2006;

9. Regulation of the Director General of Customs and Excise No. P-20/BC/2007 concerning Implementation Direction to Stipulate Customs Zone and Temporary Hoarding Place;

10. Regulation of the Director General of Customs and Excise No. P-21/BC/2009 concerning Customs Declaration of the Transportation of Goods as amended by Regulation of the Director General of Customs and Excise No. P-28/BC/2010;

11. Regulation of the Director General of Customs and Excise No. P-26/BC/2010 concerning Model, Color, Size and Seal of Customs and Excise and Sealing Procedures;

HAS DECIDED:

To stipulate:

REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE CONCERNING PROCEDURE TO NOTIFY INWARD MANIFEST OF CARRIER AND OUTWARD MANIFEST OF CARRIER IN THE FRAMEWORK OF CARRYING IMPORTED GOODS AND EXPORTED GOODS TO AND FROM CUSTOMS ZONE IN INTEGRATED CUSTOMS SERVICE ZONE

CHAPTER I
GENERAL PROVISION

Article 1

In this Regulation of the Director General:

1. Imported Goods are goods entered into Customs Zone.

2. Exported Goods are goods released from Customs Zone to be carried or sent abroad.

3. Customs Zone is area with certain borders in seaport, airport, and Other Place stipulated for the traffic of goods, under full supervision of the Directorate General of Customs and Excise.

4. Integrated Customs Service Area hereinafter abbreviated as KPPT is an area where customs and excise service is centralized, such as Temporary Hoarding Place, Bonded Hoarding Place and Consolidation Place of Exported Goods, and can be furnished with other business place in the framework of supporting the smooth traffic of imported and exported goods.

5. Director General is the Director General of Customs and Excise.

6. Customs and Excise Official is an employee of the Directorate General of Customs and Excise appointed in certain position to execute specified tasks based on Customs Law.

7. Customs Office is an office within the Directorate General of Customs and Excise where the customs liabilities are fulfilled.

8. Port in KPPT is a certain area on shore, which functions as port, already stipulated by the ministry in charge of port affairs as the extension of the main port located in KPPT.

9. Transporter shall be a person, its proxy, or one responsible for the operation of Carrier that carries goods and/or people.

10. Carrier is vehicle/transportation mean in sea, air, or land that is used for carrying goods and/or people.

11. Transshipped Goods are goods carried by Carriers through Customs Office by means of unloading.

12. Inward Manifest of Carrier hereinafter called Inward Manifest is a list of commercial freight carried by Carriers through sea, air and land upon entering Customs Area.

13. Outward Manifest of Carrier hereinafter called Outward Manifest is a list of trading goods carried by Carrier through sea, air, and land upon leaving Customs Zone.

14. Export Loading Port is a seaport or airport where the exported goods are loaded into:

15. Electronic Data Exchange hereinafter abbreviated as PDE is a flow of business information between applications and organization electronically, integrated by using agreed standard.

Article 2

(1) Imported goods may be removed from Customs Zone at unloading port to be carried into Custom Zone in KPPT.

(2) Exported goods may be removed from Customs Zone in KPPT to be carried to Customs Zone at Export Loading Port.

(3) Imported Goods or Exported Goods that are removed and carried from Customs Zone as intended in paragraph (1) and paragraph (2) are Goods for Transshipment.

(4) Movement and transportation of goods as intended in paragraph (1) and paragraph (2) may be conducted in Customs Zone in KPPT if it is already stipulated as Port in KPPT.

CHAPTER II
MOVEMENT AND TRANSPORTATION OF IMPORTED GOODS TO BE TRANSSHIPPED TO CUSTOMS ZONE IN KPPT

Article 3

Imported goods with ending destination of transportation being port in KPPT as contained in the transportation document may be entered into Customs Zone in KPPT.

Article 4

(1) Transporter who is planning to enter the imported goods with the ending destination of transportation being port in KPPT as intended in Article 3 is obliged to declare the carried Imported Goods by a declaration in the form of Inward Manifest to Customs and Excise Officials at Customs Office supervising Customs Zone at the unloading port in the group of imported goods will be transshipped.

(2) The inward Manifest as intended in paragraph (1) already received and securing number and date of registration in Customs Office that supervises Customs Zone at the unloading port, is customs declaration with code BC 1.1.

Article 5

(1) Transporter will move and carry Imported Goods with ending destination of transportation to the Port in KPPT as intended in Article 3 from Customs Zone in unloading port to be transshipped, is obliged to submit declaration of Outward Manifest to Customs and Excise Official in Customs Office that supervises Customs Zone in unloading port in the group of imported goods will be transshipped.

(2) Outward Manifest as intended in paragraph (1) already received and securing number and date of registration in Customs Office that supervises Customs Zone at the unloading port, is customs declaration with code BC 1.1.

(3) Customs and Excise Official examines data of the Transshipment Imported Goods in Outward Manifest already securing number and date of registration as intended in paragraph (2) and data on the Transshipment Imported Goods in Inward Manifest already securing number and date of registration as intended in Article 4 paragraph (2).

(4) In case of result of the examination as intended in paragraph (3) not matching, Customs and Excise Official shall issue a Note of Result of Manifest Examination (NHPM) in accordance with sample format as stated in Attachment I, which constitutes an integral part of this Regulation of the Director General, namely:

(5) In case of result of the examination as intended in paragraph (3) matching or rectification being already executed in accordance of the Note of Result of Manifest Examination (NHPM) as intended in paragraph (4), the Customs and Excise Official shall issue a Letter of Approval of the Movement and Transportation of imported goods from Customs Zone at the Unloading Port to be transshipped to Customs Zone in KPPT (BCF.1.1.A) in accordance with sample format as stated in Attachment II, which constitutes an integral part of this Regulation of the Director General.

(6) The Approval of the Movement and Transportation of imported goods from Customs Area at the Unloading Port to be transshipped to Customs Zone in KPPT (BCF.1.1.A) as intended in paragraph (5), is used as a basis to remove and carry Imported Goods will be transshipped from Customs Zone at the unloading port.

Article 6

(1) Transporters planning to remove and carry imported goods, which are carried further, from Customs Area at the unloading port in Customs Area in KPPT shall be obliged to submit declaration in the form of Inward Manifest to Customs and Excise Official in Customs Office overseeing Customs Area in KPPT in the group of imported goods with the customs obligations being settled in local customs office.

(2) The inward Manifest as intended in paragraph (1) already received and securing number and date of registration in customs office overseeing customs area in KPPT shall constitute customs declaration with code BC 1.1.

CHAPTER III
MOVEMENT AND TRANSPORTATION OF EXPORTED GOODS WILL BE TRANSSHIPPED FROM CUSTOMS ZONE IN KPPT

Article 7

(1) Transporter will remove and carry exported goods from Customs Zone in KPPT to be exported through Customs Zone at export loading port are obliged to submit declaration in the form of Outward Manifest to Customs and Excise Official in Customs Office overseeing Customs Zone in KPPT in the group of Exported Goods are loaded in local Customs Office.

(2) The Outward Manifest as intended in paragraph (1) already received and securing number and date of registration in Customs Office overseeing Customs Area in KPPT, is customs declaration with Code BC 1.1.

(3) Customs and Excise Official shall examine data of goods will be exported in Outward Manifest already securing number and date of registration as intended in paragraph (2) and reconcile Outward Manifest with the Declaration of the Exported Goods (PEB).

(4) In case result of the examination as intended in paragraph (3) not matching, Customs and Excise Official shall issue Note of Result of Manifest Examination (NHPM) in accordance with sample format as stated in Attachment I, which constitutes an integral part of this Regulation of the Director General, namely:

(5) In case of result of the examination as intended in paragraph (3) matching or rectification being already executed in accordance with NHPM as intended in paragraph (4), Letter of Approval of the Movement and Transportation of Exported Goods from Customs Area in KPPT to be transshipped to Customs Zone at the Export Loading Port (BCF.1.1.B) shall be issued in accordance with sample format as stated in Attachment III, which constitutes an integral part of this Regulation of the Director General.

(6) The Letter of Approval of the Movement and Transportation of Exported Goods from Customs Area in KPPT to be transshipped to Customs Area at the Export Loading Port (BCF.1.1.B) as intended in paragraph (5), shall be used as a basis to remove and carry the goods will be exported from Customs Area in KPPT to Customs Area at the export loading port.

Article 8

(1) Transporter will remove and carry exported goods from Customs Area in KPPT to Customs Area at the export loading port shall give application in the form of Inward Manifest to Customs and Excise Official in Customs Office overseeing Customs Area at the export loading port by notifying the Exported Goods which are to be exported through Customs Zone at the export loading port in the group of the Exported Goods are unloaded to be transshipped.

(2) The Inward Manifest as intended in paragraph (1) already received and securing number and date of registration in Customs Office overseeing Customs Area at the export loading port shall constitute customs declaration with code BC 1.1.

CHAPTER IV
SEALING

Article 9

(1) The imported and exported goods are removed and carried to and from Customs Zone in KPPT:

(2) Model and kind of the seal or electronic security mark in the framework of the sealing as intended in paragraph (1) a shall be provided by management of KPPT after securing approval from the Director of Action and Investigation.

(3) The sealing as intended in paragraph (1) a shall be done by management of KPPT.

CHAPTER V
CLOSING

Article 10

(1) Model, content and directive for completing customs declaration BC 1.1 as intended in Article 4 paragraph (2), Article 5 paragraph (2), Article 6 paragraph (2), Article 7 paragraph (2), and Article 8 paragraph (2) shall be implemented in accordance with regulations govern customs declaration of the transportation of goods.

(2) The provision on period of submission, rectification and closing of customs declaration BC 1.1, as well as the obligation of transporter and sanction shall be executed in accordance with regulations govern the submission of plan for the arrival of carrier, inward manifest of carrier, and outward manifest of carrier.

(3) Procedures of Declaration of Inward Manifest of Carrier and Outward Manifest of Carrier in the framework of carrying Imported Goods and Exported Goods to and from Customs Zone in KPPT shall be stipulated in Attachments IV and V, which constitute an integral part of this Regulation of the Director General.

Article 11

This Regulation of the Director General shall come into force after 60 (sixty) days after the date of stipulation.
